1. Scope and Provider
This website is operated by Lyvola UG (haftungsbeschränkt), Ammerseestraße 30, 82061 Neuried, Germany (hereinafter referred to as "we", "us", or "Leafsy").
The following Terms and Conditions apply to all orders placed via our online shop www.leafsy.de by consumers as defined in Section 13 of the German Civil Code (BGB).
2. Subject of the Contract
Leafsy offers personalized artworks made from real leaves. Customers can upload their own image files, which are engraved onto natural leaves and framed.
Each item is a custom-made, one-of-a-kind product.
3. Conclusion of Contract
By listing products in the online shop, we make a binding offer to conclude a contract for those items.
The contract is formed when you submit a binding order by clicking the order button.
An order confirmation will be sent via email immediately after the order is placed.
4. Personalization and Image Upload
To produce your custom product, we require an image provided by you.
By uploading an image, you confirm that you have the right to use and share the file and – if other persons (e.g., children) are depicted – that their consent has been obtained.
The image is used exclusively for production purposes and is automatically deleted no later than 30 days after shipping.

5. Prices and Payment
All prices are listed in euros and include statutory VAT.
Shipping costs are added as specified during the checkout process.
Payment must be made using one of the payment methods offered in the shop and is due upon conclusion of the contract.
6. Delivery
Delivery is made to the address specified during the order process.
Production begins after payment has been received and your image has been fully uploaded.
Delivery times are displayed during checkout.
Self-collection is not possible.
7. Retention of Title
The goods remain our property until full payment has been received.
8. Exclusion of Right of Withdrawal
According to Section 312g(2)(1) BGB, the right of withdrawal is excluded for goods that are not prefabricated and are made to the consumer’s individual specifications or clearly tailored to personal needs.
Therefore, cancellations or exchanges are not possible unless the product has a manufacturing defect or was damaged in transit.

9. Warranty
The statutory warranty rights apply.
As our products are made from natural materials (e.g., leaves), natural variations in color, shape, or texture may occur. These do not constitute defects.
10. Liability
We accept unlimited liability for damages resulting from injury to life, body, or health caused by our intentional or negligent breach of duty.
For all other damages, we are liable only in cases of gross negligence or intent.
Any further liability is excluded.
11. Copyrights
By uploading an image, you confirm that no third-party rights are infringed.
If a violation does occur, you agree to indemnify us from all claims made by third parties.
12. Data Protection
We process personal data in accordance with our Privacy Policy.
This includes details on how we handle uploaded image files.
13. Applicable Law
German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
14. Dispute Resolution / Consumer Arbitration
The European Commission provides a platform for online dispute resolution (ODR):

We are not obligated or willing to participate in a dispute resolution procedure before a consumer arbitration board.
